Article 3 Commercial Transactions

Prior to delivery, the user will pay the product price and other expenses (delivery charges, etc.) by the method specified by the operator.
The operator offers the following payment methods:

3. Delivery
After confirming the payment from the user, the operator will deliver the product to the user by hand delivery or by mail.

Delivery is completed when the operator hands over the product to the user or, in the case of mailing, delivers it to the delivery company, and the ownership of the product is transferred to the user.
Delivery by personal delivery is limited to cases where it does not involve additional expenses such as transportation expenses to the operator, and the operator does not bear the expenses such as transportation expenses of the user related to this delivery method.
4. Termination of transaction
The transaction will end when the User completes the payment for the Product and the Operator completes the delivery of the Product.
Ownership of the product shall be transferred to the user when the operator delivers the product to the delivery company.
5. AFTERCARE AND WARRANTY

The operator will promptly notify the user of the number of days required for repair work after receiving and confirming the product, and will deliver the product within that date.
Postage costs for delivery shall be borne by the operator.
③ About exchange
If the user wishes to exchange the product, the user shall notify the operator within the above period of time that he/she wishes to exchange the product.
After receiving this notification, the operator may request additional information from the user to confirm the content and reason.
The user shall hand over the product to the operator by hand or by mail within 7 days after receiving the notification from the operator to the effect that the exchange is accepted. In addition, when sending by mail, it shall be delivered to the operator within the above date, and the postage shall be borne by the user.
The operator will promptly deliver a replacement product to the user after receipt and confirmation of the relevant product.
Postage costs for delivery shall be borne by the operator.
6. Cancel
As a general rule, we cannot accept cancellations after the sales contract is concluded.

The User requests the Operator to make a purchase request for a product that the User wishes to purchase, along with information on the design, size, quantity, etc., in response to which the Operator presents an estimate of the price and delivery date. The sales contract will be concluded when the user accepts the application and notifies the user of its acceptance.
At this time, the user shall be fully convinced of the material, size, and design of the requested product, which is a product.
In connection with this contract, the Operator will prepare a written estimate that describes the details of the transaction, and notify the Operator in writing that the User has confirmed receipt of the said written estimate. This notification can also be sent to the operator by the user affixing a seal on the quotation prepared by the operator.
In addition, if the design and materials of the product to be produced are undecided and a meeting is required, a "design consultation / creation fee" may be incurred prior to the above sales contract.
2. Payment
Prior to the start of production, the user pays the product price and other expenses (delivery charges, etc.) by the method specified by the operator.

After that, the operator will refund and settle the price or deposit paid by the user.
If there is a fee for the refund, it will be borne by the user.
If the user paid for the purchase by credit card, the refund will be made through the same credit card company as a general rule.
Article 4 About costume rental contract
(1) Available services and content
The User may use the costume rental service provided by the Operator for a fee for a prescribed period.
Those who use rental products provided by the operator online and offline (hereinafter referred to as "users") are required to enter into a rental contract with the operator in accordance with these Terms.
(2) Definition of rental products
The products of this service are limited to clothes and miscellaneous goods that the operator clearly states as "rental goods" and presents online or by other means.
The usage fee for each rental product (hereinafter referred to as "rental fee") is set according to the usage period desired by the user, including consumption tax.
In addition, the rental fee does not include the shipping fee, and the user will be responsible for the round-trip shipping fee.
Most of the rental products are second-hand goods, and they are one-of-a-kind items that may be remade by the operator at any time by making modifications such as rework and design changes.
(3) Conclusion of contract
1. Application for use
When the user applies to the operator to use the rental product provided by this service, along with information on the name of the product to be used, the period of use, and the desired start date of use, and the operator notifies the operator of its acceptance. A lease agreement is concluded.
However, the deadline for users to apply for use is limited to 7 business days prior to the desired start date of use.
2. How to apply
The operator uses the external service "Kashikan" in providing this rental service. This "Kashikan" manages the inventory, reservation status, and rental status of all rental products.
Each user selects and applies for the desired rental product, usage start date and usage period on the system of "Kashikan".
*If it is difficult for the user to operate "Kashikan" by himself/herself, the user can apply to the operator by email or other methods. In that case, the operator will perform the lending operation on "Kashikan" on behalf of the user. However, if the second user applies by himself/herself on "Kashikan" before the operator completes this operation, and the application contents overlap, the second user's application will take precedence.
3. Precautions when signing a contract
Prior to entering into a contract, the user shall be fully satisfied with the rental period, material, size and design of the product.
(4) Flow of payment/delivery/return

This request cannot be made if the user's own circumstances or contact with the operator has passed two days after receipt.
3. Returning rental items
The user will return the rental product within the day following the last day of the usage period. The return will be completed when the user delivers the rental product to the delivery company by prepaying the shipping fee, and then the product arrives at the operator.
We recommend using a tracked and insured shipping method for returns. In the event that an attempt is made to return the product by a non-guaranteed delivery method, resulting in non-delivery, loss, etc., the user will be required to pay the operator compensation for damages as stipulated in Article 4 (3) of this provision. increase.

Items similar to the rental product are different clothing and miscellaneous goods that have the same basic design as the rental product, and are newly manufactured and sold by the operator with different fabrics, materials, sizes, etc. from the rental product. .
According to their own wishes, users can request changes in size and design details compared to rental products, specify the fabrics and materials to be used, and submit production requests to the operator.
In response to this, the operator determines whether to accept the request content, and if it can accept the order, concludes a new commercial transaction contract with the user.
You can apply for a similar product production request at any time, regardless of whether or not you use the rental product and the period of use.
However, if an application is made during the rental period, the production request for a similar product will be treated as a special order product transaction, and the rental contract for the rental product must be completed separately.
2. Transfer of ownership
The operator may transfer the ownership of a specific rental product for a fee if the user so desires.
Rental items whose ownership is transferable have a selling price that is separate from the rental fee. By paying a price equivalent to this sales price separately from the rental fee, the user can transfer the ownership of the product from the operator.
The transfer of ownership is a transition from a "lease agreement" to a "inventory transaction."
During the period of use of the rental item, the user applies to the operator for a request to transfer the ownership, obtains the operator's consent, and completes the payment for the commercial transaction, thereby renting the rental item without returning it to the operator. You can terminate the contract.
Please note that not all rental products are transferable.
In addition, the operator can freely set and change the transfer price at any time.
Article 5 Prohibitions
(1) Prohibition of infringement of intellectual property rights
Users may not sell works and copyrighted materials (including designs, patterns, and texts) created or published by the operator for commercial purposes without the permission of the operator.
In addition, duplication, reprinting, modification, and secondary use of works and copyrighted materials created or published by the operator are prohibited.
(2) Prohibition of transfer of rights and obligations regarding products
Users may not transfer their rights and obligations under these Terms to a third party. Therefore, the User is not permitted to sublease or change the name of the rental product.
However, if the ownership of a specific rental product is transferred by the method shown in Article 4 (7) 2. of these Terms, the user can make the rental product under his/her own name.
In addition, users may not claim rights to products that they own before they own them.
(3) Other prohibited items
The following acts intentionally or negligently are strictly prohibited.
① Acts that violate laws or public order and morals and acts related to criminal acts
②Acts that destroy or interfere with the functions of the operator's server or network, or attempt such acts

④ Acts of impersonating another user

Article 6 Change of service contents and suspension of provision

(2) Suspension or suspension of service provision

③Damage due to material, product shape and design
The user shall be deemed to have agreed to the material, product shape and design of the product at the time of application for purchase.

④Damage suffered by the user due to the user's own negligence when using or using the services and products provided by the operator

Article 8 Handling of personal information
The operator appropriately manages the personal information of users based on the Personal Information Protection Law and the privacy policy established by the operator.
Article 9 Others
(1) The contents of this agreement may be changed as appropriate after consultation between the operator and the user if necessary. This is limited to cases in which the contents of the discussion change are documented in advance and are stored after both parties have agreed.
② The operator may restrict the use of users who violate these terms.
(3) Matters not described in these Terms and the documents presented or any other doubts arise shall be resolved through consultation between the operator and the user.
④The Terms shall be governed by and interpreted in accordance with Japanese law.
⑤ If a lawsuit arises regarding this Agreement, the Summary Court or Kobe District Court shall be the competent court.
